Terms and Conditions for Kelly Mahalak (KFM Coaching)

Please read these Terms of Use carefully before purchasing, accessing, or using any of our Programs, Products and Services.

Terms of Use
Our Programs, Products, and Services are owned and operated by Kelly Mahalak (“Company”, “we”, or “us”). The term “you” refers to any purchaser and/or user of any of our Programs, Products and/or Services.

We reserve the right to change these Terms and Conditions at any time. If you do not agree with these Terms and Conditions, please do not use our website or purchase from Kelly Mahalak.

By purchasing or using any of our Programs, Courses, Trainings, Products, Website or Services ("Material"), you agree to abide by these Terms of Use as well as any other terms and conditions that may apply.

All users of our material must be at least 18 years old.

The content in all of our material is the property of Kelly Mahalak and is intended for personal use only. It is not to be duplicated, sold, shared, stolen, modified, copied or repurposed. You understand that doing any of the before-mentioned activities is considered theft and we retain the right to take legal action against you.

If you participate in a live training or if you are in a video, Kelly Mahalak owns all rights to this material and may use or distribute the content as seen fit.

Any testimonials (written or verbal) posted in a Voxer chat, Facebook group or comments, or sent to Kelly Mahalak, become the property of Kelly Mahalak. Screenshots can/will be used anonymously to promote the container. If you post a testimonial to a container owned by Kelly Mahalak you consent to these terms and the use of your testimonial as Kelly sees fit.

Request for Permission to Use Content.
Any request for written permission to use our material, should be made prior to using it by sending an e-mail to kellymahalak@gmail.com

Third Party Platforms
Courses, Programs, and Coaching may be hosted on Third Party Platforms such as Facbook, Tiktok, Voxer etc. These Terms apply to all Third Party Platforms. You also understand that Kelly Mahalak does not own the platforms used to host content. These may be public platforms and therefore, we cannot guarantee your privacy for things that you share in the group as other members will also see what is posted.

We will not tolerate any kind of bullying, scam, or hate messages within our communities or DM. If you violate this, we can and will ban you from the community and block your profile.

Communication Guidelines.

Purchases and Payment Plans.
If paying by debit card, credit card, PayPal or Stripe you give us permission to automatically charge your credit or debit card as payment for your Program, Product or Service without any additional authorization, for which you will receive an electronic receipt for the initial transaction.

In the event that payment is not received by the date due, an attempt to correct the error will be made.

If payment has not been made and no alternate payment arrangement has been mutually agreed upon, within 10 days of your scheduled payment date, the Program, Product, or Services will not continue and we reserve the right to cease access immediately until full payment has been collected.

Your payment will be charged on a reoccurring basis on the terms that you have agreed to pay. If your payment fails on the date that it is due, we may attempt to re-process your payment without notice.

In the event that you dispute a charge for a Program, Product or Service, your access will be revoked immediately.

All information obtained during your purchase or transaction for our Programs, Products, and Services and all of the information that you give as part of the transaction, such as your name, address, method of payment, credit card number, and billing information, may be collected by both us and our payment processing company.

Refund Policy.
Due to the nature of our Programs, Products, and Services, Kelly Mahalak has a limited refund policy. No questions asked refunds will be made upon request to kellymahalak@gmail.com up to 72 hours after the program begins and the initial content, call, or online event was held or made available. After 72 hours, you may contact kellymahalak@gmail.com to express your questions, concerns, or dissatisfaction. We will respond within 72 business hours with a plan to correct or clarify. If we determine that correction cannot be made, a refund will be made. Refunds may take up to 30 days to process. By purchasing any of our offers, you understand and agree to these terms and that once a program has started, refunds are at the full discretion of Kelly Mahalak. Should you decide to terminate your participation in any of our Programs, Products and Services, without grievance, you remain responsible for all remaining payments.

As the client, you are are responsible for knowing the program schedule, consuming content, and attending calls and events. Lack of participation or attendance is not a valid reason for a refund. YOU ARE RESPONSIBLE FOR THE COMPLETION OF ALL PAYMENTS REGARDLESS OF THE UTILIZATION OF THE CONTAINER. 

Termination.
We reserve the right to terminate your participation in any of our Programs, Products and Services at any time.

In the event of cancellation or termination by either of us, you will be expected to make any remaining payments as scheduled and agreed to upon purchase unless a refund has been agreed to by Kelly Mahalak.
